Can I Apply For Debt Review With My Spouse?

Short answer:

Yes. You and your spouse can apply for debt review together, but whether you need to do so depends on your marital regime and financial circumstances. Couples married in community of property generally need to apply jointly. If you are married out of community of property, one spouse may generally apply individually, although joint debts and shared household finances may still affect the assessment.

How Does My Marital Regime Affect Debt Review?

  • Married in community of property: You and your spouse generally need to apply for debt review jointly. Your shared financial position, including relevant income, expenses and debts, will be considered during the assessment.
  • Married out of community of property: You may generally apply individually if you are the spouse experiencing financial difficulty. However, joint credit agreements, shared household expenses and other financial commitments may still be considered. Your spouse does not automatically have to enter debt review simply because you apply.
